Responsibility and Liability

Town Cars Australia and its Operators are responsible solely for the transport or services provided as part of your booking. The company does not hold liability for any other transport or services outside of what is confirmed in your booking.

Town Cars Australia reserves the right, without prior notice, to substitute means of transportation or service suppliers. Cancellations or delays may result from industrial disputes, route restrictions, unsuitable weather, road works, or unforeseen acts of nature.

All transportation bookings are finalized and scheduled only once Town Cars Australia confirms acceptance via email or SMS and full payment is received in accordance with company terms and conditions.

Waiting Time Policy

Waiting charges are $1.50 per minute.

Outbound Waiting:

  • 30 minutes of complimentary waiting time for pickups from Perth Domestic Airport, starting from the time of flight landing.
  • 60 minutes of complimentary waiting time for pickups from Perth International Airport, starting from the time of flight landing.
  • 15 minutes of complimentary waiting time for pickups from Fremantle Passenger Terminal, starting from the confirmed schedule. Additional waiting time is calculated in 15-minute increments based on the type of vehicle.

Inbound Pickup Waiting:

  • 10 minutes of complimentary waiting time from the scheduled pickup time. Additional waiting time may incur extra charges.
  • After one hour of waiting, it is at the sole discretion of the driver whether to continue waiting (with waiting time charges applied) or to cancel the trip at full charge, as other scheduled jobs may prevent further waiting.
  • Real-time flight tracking and automated alerts ensure punctuality.

Cancellation Policy

Sedan/SUV:

  • Single & Round-trip transfers:
  • Cancellations within 24 hours may incur cancellation fees.
  • Cancellations within 4 hours will incur full charges.
  • As-Directed/Hourly bookings: Minimum booking duration is 4 hours.
  • Cancellations require at least 24 hours’ notice prior to pickup; failure to do so will result in full charges.
  • Maximum of 20 km per hour as an average over the booked hours. Extra kilometers are charged at $3.00 per kilometer.
  • Service is provided within a 50 km radius of the CBD.

VAN:

  • Single & Round-trip transfers:
  • Cancellations within 24 hours may incur cancellation fees.
  • As-Directed/Hourly bookings: Minimum booking duration is 4 hours.
  • Cancellations require at least 24 hours’ notice prior to pickup; failure to do so will result in full charges.
  • Maximum of 20 km per hour as an average over the booked hours. Extra kilometers are charged at $5.00 per kilometer.
  • Service is provided within a 50 km radius of the CBD.
    Amendments
  • Any change in booking (pickup or drop-off time) within 4 hours of the scheduled time may result in waiting charges being applied.
  • Complimentary waiting time still applies, and waiting fees will be calculated after the original complimentary period has elapsed. Refer to the Waiting Time Policy for more details.

General

  • Payments made in the car or at the office via credit card will incur a surcharge.
  • Certain events, such as weddings or major events, may attract additional charges. Please contact us to confirm if extra fees apply.

Public Holiday Surcharge

A 20% surcharge applies to all rates on Public Holidays.

Miscellaneous Services and Charges

  • 10% Late Night/Early Morning surcharge applies for trips between 10:30 PM – 11:29 PM and 4:30 AM – 5:59 AM.
  • 20% Wee hour charges apply for trips between 11:30 PM – 4:29 AM.
  • Child seat charges (seat, booster, or capsule) are $11 per seat.
    Liability

Town Cars Australia is not liable for any loss or damage resulting from the negligence, act, or omission of any supplier or third party. Where liability cannot be excluded, it is limited to the value of the purchased travel arrangements.

Food & Beverage Consumption

Food and beverages may not be consumed in any vehicle without prior approval. If approval is granted, a bond may be required to cover potential vehicle damage. Responsibility for any such damage is governed by these terms and conditions.

Smoking

Smoking is not permitted by Western Australia law in any vehicle supplied by Town Cars Australia.

Damage to Vehicle

Clients are responsible for charges levied by suppliers for any damage caused to a vehicle as a direct result of their booking. Clients are not responsible for damage caused by supplier employees. Drivers may stop and ask any passengers engaging in unacceptable or unruly behavior to disembark.

Inappropriate Behavior

Passengers acting in an anti-social manner, distracting the driver, or causing safety concerns will be asked to leave the vehicle and seek alternative transport. No refunds will be provided in such cases. A cleaning fee (starting at $500) will be billed for damage such as soiling, vomiting, damaging the interior, or spilling liquids.

Seat Belt

By law in Western Australia, all drivers and passengers must wear seat belts if fitted. Seat belts may only be used by one person at a time while the vehicle is in motion. Doubling up, or sharing a seat belt, is illegal and unsafe.

Child Restraints

The use of child car restraints is required by law in Western Australia. Children from birth to six months must use a rearward-facing restraint (infant capsule). From six months to four years, children must use either a rearward or forward-facing restraint with an in-built harness. From four years up to seven years, children must use a forward-facing or booster seat, restrained with a seat belt or safety harness. Non-compliance may result in fines and demerit points.

On Time

Town Cars Australia will take all reasonable steps to provide on-time service. However, in the unlikely event of a delay caused by circumstances beyond our control, no liability will be accepted for lateness.

Insurance

Public liability insurance is provided, but this is not travel insurance. While every effort is made to safeguard personal property, liability is not accepted for loss of personal items. Please ensure you have adequate insurance coverage for your belongings.

Lost & Found

We will attempt to return any items left in the vehicle to the hirer or items may be collected from our office. We are not responsible for personal items left in the vehicle during or after hire.

Locating Your Driver

Upon arrival at the pickup location, you will receive a greeting SMS with your driver’s name and mobile number. The driver will wait for you after you disembark, holding a sign with your name.

Disclaimer

Responsibility for injury, sickness, or death of the account holder or passengers is not accepted, except where such incidents are proven to be caused by the negligence of Town Cars Australia.

Force Majeure

We are not liable for loss or delay resulting from strike actions, industrial disputes, riots, political unrest, hostilities, war or the threat of war, terrorism, fire, flood, technical or weather problems with airlines or ferry operators, or any event beyond our control.

Prices are subject to change without notice.

Amendments to Terms and Conditions

Town Cars Australia reserves the right to amend these terms and conditions without notice. Please review these terms at the time of booking and before your transfer, as no notification of changes will be provided.
